The third session of the Committee on Urbanism, Housing and Construction

The third session of the Committee on Urbanism, Housing and Construction

The third session of the Committee on Urban Planning, Housing and Construction of SCTM was held on Tuesday, 19 March 2019 in Belgrade. The meeting was chaired by the President of the Committee Ivan Bogdanovic Mayor of Lebane. The session discussed several current topics from the scope of work of the department for urban and construction affairs in towns and municipalities.

The implementation of the Law on Fees for the Use of Public Goods under the jurisdiction of local departments for urban planning and construction, specifically on fees for the use of public roads and fees for the use of public spaces was discussed. The members of the Committee concluded that it is necessary to request the opinion of the relevant Ministry regarding the application of certain provisions of the Law on Fees concerning the determination of the amount of the fee for the use of roads and the use of public spaces (placement of advertising boards, temporary facilities and installation of underground installations).

At the session of the Committee, the initiative for amending the Law on Conversion of Building Land was also considered. It was prepared by the Expert Service of the SCTM on the basis of the conclusions of the workshops held in October 2018 organised by the SCTM. The members of the Committee agreed with the proposals for amending this regulation which could in principle increase the number of resolved requests for conversion and facilitate the work of property and legal services at the local level. It was also suggested that the initiative should be completed with some proposals that would be aimed at resolving the status of the complex of land.

Activities on the project "Sustainable urban mobility in towns and municipalities in Serbia" were presented. This SCTM project will be implemented in partnership with the German organisation GIZ. The members of the Committee are invited to apply for a public call for the selection of a pilot town/municipality who will receive support in the preparation of the Sustainable Urban Mobility Plan. Within the same point, a proposal for the establishment of the SCTM Working Group on Sustainable Urban Mobility was adopted. The Committee appointed two members from the municipalities of Sopot and Stari Grad for membership in this Working Group.

The activities of the project "EU Support to the Inclusion of Roma" in the area of legalisation were announced. Discussions were held on the modalities of support that local self-governments can gain in order to speed up the procedures for the legalisation of illegally built facilities owned by persons belonging to the Roma national minority.

The members of the Committee raised the issue of the application of the Law on the legalisation of facilities after the RGI sent the letter to all units of local self-government - "Notice on Visibility of Facilities" in accordance with Article 23 of the mentioned Law. Committee members noted that there are still doubts as to how individual legal proceedings are initiated - whether ex officio or at the request of the party. The Committee concluded that an urgent request should be sent from the session to the Ministry with a request for an opinion on the application of this article of the Law.
